NOTICE OF SALE UNDER POWER GEORGIA, EMANUEL COUNTY
Under and by virtue of the power of sale contained in a Deed to Secure Debt from Cynthia D. Pena to O.F.A. Investments, Inc., A Georgia Corporation, dated March 4, 2013, recorded in Deed Book 382, Pages 38-43, Emanuel County, Georgia records. Said Deed to Secure Debt having been given to secure a note dated March 4, 2013, in the original principal sum of Eleven Thousand Three Hundred and 00/100 ($11,300.00) Dollars with interest from date at the rate stated in said note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Emanuel County, Georgia within the legal hours of sale on the first Tuesday in April, 2025, the property described in said Deed to Secure Debt, to wit:
ALL that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Emanuel, and being known and designated as Lot 1, containing 0.76 acres, more or less, and Lot 2, containing 0.72 acres more or less, and fronting on Princess Street, as more particularly shown on a plat thereof recorded in the Office of the Clerk of the Superior Court for Emanuel County, Georgia in Plat Book 20, Page 42A; reference being made to said plat for a more complete and accurate description as to the metes, bounds, and location of said property Said property is commonly known as 221 Durden Road, Twin City, Georgia 30471.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, the non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including legal fees.
This sale will be held subject to all unpaid taxes, assessments, and restrictions of record, if any, transfer tax and all state and county taxes.
Said property will be sold as the property of Cynthia D. Pena, the property to the best information, knowledge, and belief of the undersigned, being presently in the possession Cynthia D. Pena, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said deed, and the balance, if any, will be distributed as provided by law.
Terms of the sale are to be cash, purchaser paying for papers, revenue stamps, and all state and county taxes.
