By virtue of a power of sale contained in a certain security deed from Jerry A. Braddock Jr and Brandi L. Braddock to Bank of America, N.A. and recorded in Deed Book 273, Page 409, Emanuel County, Georgia records given to secure a note in the original amount of $180,000.00 with interest on the unpaid balance until paid, as last assigned to Federal Home Loan Mortgage Corporation, as Trustee for Freddie Mac SLST 2022-1 Participation Interest Trust by virtue of the assignment recorded in Deed Book 543, Page 14, Emanuel County, Georgia records, the following described property will be sold at public outcry to the highest bidder for cash at the courthouse door of EMANUEL COUNTY, Georgia, or such other location within the legal hours of sale on the first Tuesday in February, 2024, to wit: February 06, 2024, the following described property:
An that tract or parcel of land lying, situate, and being in the 53rd G. M. District of Emanuel County, Georgia, in Westbrooke Subdivision, containing 4.885 acres, more or less, and being more particularly shown on a certain Plat of Survey prepared by George William Donaldson, Registered Surveyor, dated January 15, 2003, and recorded in Plat Book 21, page 35, in the Records of the Office of the Clerk, Emanuel Superior Court, which plat and record thereof are incorporated herein by reference and made a part of the description. Said tract is triangular in shape and is bounded, now or formerly, as follows, to-wit: North by the right-of-way of County Road No. 504, a/k/a Robin Circle; Southeast by lands of John A. Rountree and William E. Simmons; and West by the right-of-way of County Road No. 504, a/k/a Robin Circle.
The above described property is the same as that conveyed by Warranty Deed dated January 17, 2003 from John A. Rountree and William E. Simmons to Jerry Allen Braddock, Jr. and Brandi L. Braddock, which is recorded in Deed Book 195, pages 562-563 of the Records of the Office of the Clerk, Emanuel Superior Court.
SUBJECT TO: Those certain Restrictive Covenants, dated April 1, 1987, and recorded in Deed Book 1, 251-254 of the Emanuel County Deed Records.
Being real property commonly known as 74 Robin Boulevard, Swainsboro, GA 30401.
The debt secured by the above-referenced security deed has been declared due because of the default in the payment of said debt per the terms of the note and other possible defaults by the borrower or the successor thereto. The debt remaining in default, this sale will be made for the purpose of paying the debt and all expenses of this sale including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said sale will be made subject to the following items which may affect the title to said property: All restrictive covenants, easements and rights-of-way appearing of record, if any; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; all outstanding or unpaid bills and assessments for street improvements, curbing, garbage, water, sewage and public utilities which may be liens upon said property; and any outstanding taxes, assessments and other liens superior to the security deed being foreclosed hereby.
