Eight sentenced in Superior Court

The following occurred during the Emanuel County Superior Court October 2024 term:

Carl Kelley, repeat offender, negotiated a guilty plea on one count theft by receiving. He was fined $50 with 10 years, 5 years to serve, bal. prob.; one count theft by receiving with 5 years to serve to run concurrent with count one; one count theft by receiving with 5 years to serve to run concurrent with count one and two; one count theft by receiving with 5 years to serve to run concurrent with count one, two and three. Defendant is sentenced for a total of 10 years to be served on probation, with the first 5 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 5 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).

Susan Atkinson negotiated a guilty-alford plea on one count possession of meth. She was fined $50 with 3 years probation; one count possession of drug related objects with 12 months probation to run concurrent with count one. Defendant is sentenced for a total of 3 years to be served on probation. The above sentence may be served on probation provided the defendant shall comply with the Conditions of Probation imposed by the Court as part of this sentence.

Dashaun Lewis negotiated a guilty-alford plea on one count riot in penal institution. He was fined $50 with 20 years, 2 years to serve, bal. prob; one count aggravated battery with 20 years, 2 years to serve to run concurrent with count one. Defendant is sentenced for a total of 20 years, with the first 2 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 2 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence.

Leilani Dakota Beneteau negotiated a guilty plea on one count possession of meth. He was fined $50 with 2 years probation. Defendant is sentenced for a total of 2 years to be served on probation. The above sentence may be served on probation provided the Defendant shall comply with the Conditions of Probation imposed by the Court as part of this sentence.

Darius Bell negotiated a guilty-alford plea on one count possession of meth. He was fined $50 with 8 years, 5 years to serve, bal. prob.; one count fleeing and eluding with 5 years to serve to run concurrent with count one; one count interference w/gov. property with five years to serve to run concurrent with count one and two; one count driving while license suspended with 12 months to serve to run concurrent with count one, two and three; one count possession of marijuana with 12 months to serve to run concurrent with count one-four; one count speeding with 12 months to serve to run concurrent with count one-five. Defendant is sentenced for a total of 8 years, with the first 5 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 5 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence.

Darius Bell negotiated a guilty-alford plea on one count sale of meth. He was fined $50 with 15 years, 5 years to serve bal. prob. Defendant is sentenced for a total of 15 years, with the first 5 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 5 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence.

Jimmy T. Alston, repeat offender, negotiated a guilty plea on one count fleeing or eluding law enforcement with 10 years to serve; one count DUI. He was fined $300 with 12 months probation to run consecutive with count one; one count driving with suspended license with 12 months probation to run consecutive with count one; one count obstruction of law enforcement officer with 12 months probation to run consecutive with count one; possession of marijuana less than ounce with 12 months probation to run consecutive with count one; possession of drug related objects with 12 months probation to run consecutive with count one; one count speeding with 12 months probation to run concurrent with count one. Defendant is sentenced for a total of 11 years, with the first 10 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 10 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(c).

The following occurred during the Emanuel County Superior Court January 2025 term:

Buddy Murphy, repeat offender, negotiated a guilty plea on one count fleeing with 5 years to serve; one count driving while license suspended. He was fined $50 with 12 months probation to run consecutive with count one; one count expired tag with 12 months probation to run consecutive with count one and two. Defendant is sentenced for a total of 7 years, with the first 5 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 5 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(c).

Janice Wadley negotiated a guilty plea on one count stalking. She was fined $100 with 12 months. Defendant is sentenced for a total of 12 months to be served on probation. The above sentence may be served on probation provided the Defendant shall comply with the Conditions of Probation imposed by the Court as part of this sentence.
